Liability Disclaimers and Limitations of Liability

Kishreeja LLC, doing business as Travellios (“Travellios,” “we,” “us,” or “our”), provides an online platform that facilitates travel bookings and connections between travelers (“Service Takers” or “ST”) and individuals who voluntarily provide travel companion or support services (“Service Providers” or “SP”).

By accessing or using Travellios, you acknowledge and agree to the following disclaimers and limitations of liability.

1. Platform Role

Travellios is a technology platform that facilitates connections, bookings, payments, communications, and related travel-support services between users.

Except where expressly stated otherwise, Travellios is not the airline, transportation carrier, hotel, airport, medical provider, immigration authority, government agency, or other third-party travel service provider.

Travellios does not independently operate, control, or guarantee the services provided by airlines, airports, transportation companies, hotels, Service Providers, or other third parties.

2. Travel Services and Third-Party Providers

Airline tickets, transportation, baggage services, schedules, airport services, and other travel products may be provided by third parties.

Travellios does not guarantee:

  • Flight schedules, routes, availability, or operating times;
  • Airline equipment or aircraft;
  • Delays, cancellations, diversions, or missed connections;
  • Baggage handling or baggage delivery;
  • Airport security or immigration processing;
  • Availability of wheelchairs or other airport assistance;
  • Actions or decisions of airlines, airports, immigration authorities, customs authorities, or other government agencies; or
  • The performance, availability, or quality of third-party travel services.

Third-party services may be subject to the terms, conditions, policies, and limitations imposed by the applicable provider.

3. Service Provider Disclaimer

Service Providers are independent users of the Travellios platform and are not employees, agents, representatives, or contractors of Travellios solely because they use the platform or provide travel companion services through it.

Travellios does not guarantee that a Service Provider will:

  • Arrive on time;
  • Complete the journey;
  • Provide all requested assistance;
  • Have the experience or qualifications expected by a Service Taker;
  • Be available for the entire journey;
  • Follow all instructions provided by a Service Taker; or
  • Meet a particular expectation, preference, or requirement.

Travellios may facilitate verification, reviews, ratings, communications, and dispute processes, but these measures do not constitute a guarantee of a Service Provider's conduct, identity, suitability, reliability, or performance.

4. Service Taker Responsibility

Service Takers are responsible for providing accurate and complete information regarding their journey, travel requirements, support needs, preferences, and other information necessary to arrange the requested service.

Service Takers remain responsible for complying with applicable airline, airport, immigration, customs, visa, passport, baggage, health, and other travel requirements.

Travellios does not guarantee that a Service Provider or any other person will be permitted to assist a Service Taker in a particular area of an airport, aircraft, immigration facility, security area, or other restricted location.

5. Personal Decisions and Travel Requirements

Users are responsible for making their own decisions regarding travel, bookings, travel companions, and use of the platform.

Users should independently determine whether a particular travel arrangement, Service Provider, or support service is appropriate for their individual circumstances.

Travellios does not provide medical, legal, immigration, financial, or professional advice.

6. No Guarantee of Safety

Travellios takes reasonable measures intended to support a safer platform experience, including applicable verification, platform controls, reporting mechanisms, and user reviews.

However, Travellios cannot guarantee the safety, security, conduct, honesty, reliability, or behavior of any user or third party.

Users acknowledge that travel and interactions with other individuals involve inherent risks, including risks associated with transportation, airports, unfamiliar locations, delays, personal interactions, loss or damage to property, and other unforeseen circumstances.

Users are responsible for exercising reasonable judgment and taking appropriate precautions.

7. User-to-User Interactions

Travellios is not responsible for disputes, disagreements, misunderstandings, injuries, losses, damages, or other issues arising directly between Service Takers and Service Providers, except to the extent caused by Travellios's own acts or omissions for which Travellios is legally responsible.

Users are responsible for their own interactions and conduct.

Travellios may investigate reported incidents and may take action consistent with its policies, including withholding or delaying payments, under the Payment Terms, restricting accounts, suspending accounts, or terminating access to the platform.

8. No Guarantee of Availability

Travellios does not guarantee that the platform, website, application, booking services, support services, or any particular feature will always be available, uninterrupted, secure, or error-free.

Services may be temporarily unavailable because of:

  • Maintenance;
  • Technical problems;
  • Internet or telecommunications failures;
  • Airline or third-party system failures;
  • Cybersecurity incidents;
  • Government actions;
  • Natural disasters;
  • Severe weather;
  • Labor disputes;
  • Transportation disruptions; or
  • Other circumstances beyond Travellios's reasonable control.

9. Information Accuracy

Travellios makes reasonable efforts to provide accurate information; however, travel information can change rapidly.

Travellios does not warrant that information regarding flights, schedules, prices, baggage allowances, airport procedures, travel requirements, or third-party services will always be complete, current, accurate, or error-free.

Users should verify important travel information with the applicable airline, airport, government authority, or other responsible third party.

10. Force Majeure

Travellios will not be responsible for any failure, delay, interruption, or inability to perform its obligations caused by circumstances beyond its reasonable control. This Section does not excuse Travellios from refunding money paid for services that were not performed.

Such circumstances may include natural disasters, severe weather, pandemics, epidemics, war, terrorism, civil unrest, government restrictions, strikes, labor disputes, transportation disruptions, telecommunications failures, internet outages, cybersecurity incidents, third-party service failures, or other force majeure events.

11. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Travellios provides the platform and related services on an “as is” and “as available” basis.

To the extent permitted by law, Travellios disclaims warranties, express or implied, including warranties of:

  • Merchantability;
  • Fitness for a particular purpose;
  • Non-infringement;
  • Availability;
  • Accuracy;
  • Reliability;
  • Security; and
  • Continuous or uninterrupted operation.

Nothing in these Terms excludes or limits any warranty or right that cannot lawfully be excluded or limited under applicable law.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Travellios and its owners, members, officers, employees, agents, affiliates, contractors, and vendors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to:

  • Your use of or inability to use the platform;
  • Travel delays or cancellations;
  • Missed flights or connections;
  • Loss, theft, or damage to baggage or personal property;
  • Actions or omissions of a Service Provider or Service Taker;
  • Injuries or personal disputes between users;
  • Third-party travel services;
  • Errors or inaccuracies in third-party information;
  • Unauthorized access or security incidents;
  • Platform interruptions or technical failures; or
  • Events outside Travellios's reasonable control.

This limitation applies regardless of the legal theory under which the claim is brought, including contract, negligence, tort, strict liability, or otherwise, to the extent permitted by law. This Section does not apply to liability for the fraud or willful misconduct of Travellios.

13. Liability Cap

To the maximum extent permitted by applicable law, the total aggregate liability of Travellios for all claims arising out of or relating to the platform, any booking, or these Terms will not exceed the greater of:

  1. The total Travellios Service Fees and Identity Verification Fees you paid to Travellios during the twelve (12) months before the event giving rise to the claim; or
  2. US $100.

This limitation does not apply to liability that cannot legally be limited or excluded under applicable law. This amount is the “Liability Cap” defined in Section 56 of the Terms of Use, and it does not limit any refund that Travellios owes under the Cancellation & Refund Policy or applicable law, or liability for Travellios's fraud or willful misconduct.

14. Service Provider Payments and Disputes

Travellios may hold, delay, reduce, or withhold Service Provider payments when permitted under the applicable Service Provider Terms, including where a Service Provider cancels after accepting a service, fails to appear, fails to provide the agreed service, or where a Service Taker submits a dispute.

Any investigation, refund, payment adjustment, or dispute resolution performed by Travellios does not constitute an admission of liability by Travellios.

15. Personal Injury, Property Loss, and User Conduct

Users are responsible for taking reasonable precautions for their own safety and for protecting their personal belongings.

Travellios is not responsible for personal injury, illness, death, loss of property, theft, or damage caused by another user or third party, except to the extent such liability cannot lawfully be excluded or results from Travellios's own legally actionable conduct.

Users should immediately contact appropriate emergency services or local authorities when facing an emergency or immediate safety concern.

16. Emergency and Government Assistance

Travellios is not an emergency-response provider.

In an emergency, users should contact the appropriate emergency services, airport authorities, airline personnel, police, medical professionals, or other appropriate authorities.

Travellios does not guarantee that it can intervene in an emergency, contact local authorities, provide medical assistance, or resolve an emergency situation.

17. Third-Party Websites and Services

The Travellios platform may contain links, integrations, or connections to third-party websites, applications, payment providers, identity-verification providers, airlines, airports, and other services.

Travellios does not control and is not responsible for the content, security, availability, privacy practices, or performance of third-party services.

Your use of third-party services may be subject to separate terms and privacy policies.

18. Identity Verification Disclaimer

Travellios may use third-party identity-verification services to verify certain user information.

Verification may involve information such as legal name, date of birth, government-issued identification information, and biometric verification, as handled by the applicable third-party verification provider. Biometric verification occurs only after the user accepts the separate Travellios Biometric Information Notice and Release.

Travellios does not guarantee that verification will eliminate fraud, misconduct, misrepresentation, or other risks associated with interactions between users.

Verification is not a certification of a user's character, qualifications, health, safety, or suitability.

19. No Professional or Medical Assistance

Travellios and Service Providers do not provide medical care.

Service Providers are not expected to diagnose, treat, or manage medical conditions.

Users requiring medical assistance should arrange appropriate professional medical support before traveling.

20. Indemnification

Your indemnification obligations are stated in the Travellios Indemnification policy, which forms part of the Terms of Use.

21. Applicable Law

Nothing in this Liability Disclaimer is intended to exclude, restrict, or limit any rights or remedies that cannot legally be excluded or limited under applicable federal, state, or local law.

If any provision of these Liability Disclaimers is determined to be unenforceable, the remaining provisions will continue to apply to the maximum extent permitted by law.

22. Changes to This Disclaimer

Travellios may update this Liability Disclaimer from time to time to reflect changes in its services, business practices, legal requirements, or applicable regulations.

The updated version will be posted on the Travellios website with a revised effective date. An updated version applies only to claims arising from events that occur after it takes effect.
